## Terms of Service **Last updated:** 1 January 2025 By accessing or using Tems.AI (the "Service"), operated by TemsSoft B.V. ("we", "our", or "us"), you agree to these Terms of Service. ## 1. Service Description Tems.AI is an operational knowledge management platform that helps manufacturing organisations capture, structure and deploy expert knowledge as digital work instructions. ## 2. Account Registration To use the Service, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. ## 3. Acceptable Use You agree not to: - Use the Service for unlawful purposes - Upload harmful, illegal, or infringing content - Attempt to gain unauthorised access to any part of the Service - Interfere with the proper functioning of the Service ## 4. Intellectual Property All content and technology on the Tems.AI platform is owned by TemsSoft B.V. or its licensors. You retain ownership of content you upload to the Service. ## 5. Data Processing By using the Service, you agree to our data processing practices as described in our Privacy Policy. For enterprise customers, a Data Processing Agreement (DPA) is available upon request. ## 6. Payment and Billing Pricing and payment terms are set out in your subscription agreement. All fees are exclusive of applicable taxes. ## 7. Service Availability We aim to provide high availability but do not guarantee uninterrupted access to the Service. Planned maintenance will be communicated in advance where possible. ## 8. Limitation of Liability To the maximum extent permitted by law, TemsSoft B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. ## 9. Governing Law These Terms are governed by the laws of the Netherlands. Disputes shall be resolved in the courts of Amsterdam. ## 10. Changes to Terms We may update these Terms from time to time.
